General terms and conditions
1. Legal terms
All boats offered by Ibiza Boats Villas have a rental license, insurance and safety equipment.
The different owners of the boats offered by Ibiza Boats Villas establish the conditions of the rental. The specifications are detailed in the PDF files for each boat, which are downloadable. The ignorance of a rule does not exempt from its fulfillment and responsibility.
2. Confirmation of reservation
Reservations are only effective once payment of the 50% of the total cost has been received and you have the confirmation from Ibiza Boats Villas. If you do not receive confirmation from Sea Charter Ibiza within 4 hours, please contact the agency.
3. Terms of payment
The service is contracted by paying 50% of the total cost at the time of booking and the remaining 50%, before boarding.

Fuel consumption is not included in the price. Fuel payment will be made as specified by the boat owner. The fuel will be collected at the end of the rental day in two possible ways: According to hours of navigation. The amount corresponding to the expense at the gas station.
6. Cancellation policy
If the lessee, for any reason, cancels this contract, will have to pay the lessor the following percentages of the total amount of the contract: More than one month before the start date, 25%; with less than a month and up to seven days before the start date, 50%; less than 7 days before the start date, 100%.
7. Base port
The boats offered by Ibiza Boats Villas have assigned base port. The mooring outside port is not included in the price and is subject to an extra charge.
8 Departure and return times
The rental service lasts, in most cases, 8 hours. The service will be usually done between 10:00 am and 8:00 p.m., without exceeding in any case the daytime schedule.
9. Maximum capacity
According to current regulations, in Spain the maximum capacity of a boat or yacht, regardless of its length, is: maximum 12 people IN yachts, if your license allows, a maximum of 12 people plus crew.

General conditions of reservation
GENERAL RENTAL CONDITIONS
1. This contract is exclusively for navigation up to 12 miles off the coasts of Ibiza and Formentera.
2. The lessor agrees to deliver the rental vessel, and the lessee agrees to receive it in good faith.
3. Any falsehood or deceit by the lessee in any of the specific terms of the contract will result in its immediate cancellation, with the lessee forfeiting any amounts paid.
4. This contract will not be valid until the lessor has received the agreed reservation payment, provided such payment is made before the date specified in this document.
5. Prior to the vessel’s delivery, the lessor must have received the full rental price and the corresponding deposit. Payment can be made by bank transfer, card, or cash.
6. If the lessee cancels the contract for any reason, they must pay the lessor the following percentages of the total contract amount: over one month before the start date, 25%; less than one month and up to seven days before the start date, 50%; less than seven days before the start date, 100%.
7. The lessor agrees to deliver the vessel in perfect operating and clean condition at the agreed location, date, and time. If delivery is not possible due to force majeure, such as a vessel malfunction, the lessor will immediately notify the lessee and take all possible measures to resolve the issue and/or provide another vessel of equal or superior category. If these conditions cannot be met, the lessor will refund all amounts received, and the lessee agrees not to make any further claims.
8. The lessee will use and care for the vessel and its accessories responsibly, following good maritime practices, and will take all measures to prevent loss, accidents, or damage. Special mention is made of the region’s tidal currents, accidents from sudden jibes, and proper use of the toilet.
9. If the lessor observes dangerous maneuvers or signs of inexperience by the captain during the rental period, they may terminate the rental contract early, refunding 50% of the unused rental days, excluding the day of termination. Alternatively, the lessee may replace the captain with one provided by the lessor.
10. In the event of an accident or malfunction, the lessee must contact the lessor as soon as possible. If immediate attention is required, they must follow good maritime practices, prioritizing the safety of the crew and the vessel. If the malfunction is not due to misuse and cannot be resolved promptly, the lessor will refund the proportional amount for unused rental time. However, the lessee cannot claim damages. The lessor will also try to provide an alternative vessel to ensure the lessee can continue their journey.
11. The vessel has an insurance policy covering accidents, including liability and passenger coverage, subject to the general and specific terms of the policy.
12. If an incident occurs and the insurance company does not cover all or part of the damages, costs, or liabilities, the lessee will bear all such expenses, expressly releasing the lessor from any responsibility.
13. If the lessee wishes to extend the rental period, they may do so with the lessor’s prior consent and agreement on new conditions. Delayed return of the vessel will result in a penalty of €50 per hour. If the vessel is left at a location other than the agreed return point, the lessee will pay for all associated expenses and damages.
14. If children are to be on board, the lessee must notify the lessor in advance so that the appropriate life jackets can replace adult ones.
15. The deposit received before embarkation serves to cover damages, losses, theft, or delays not covered by the insurance. If damages exceed the deposit, the lessee must pay the difference. The deposit will be refunded after the vessel’s condition is verified. If the rental is made without a deposit, the lessee will assume the costs of any damage or loss.
16. At the agreed return time, the crew and luggage must be disembarked, leaving the vessel ready for inspection.
17. Provisioning, fuel, docking fees, and crew costs, if applicable, are the lessee’s responsibility. The departure port mooring is included in the price.
18. It is strictly prohibited to bring weapons, drugs, contraband, cargo, paying passengers, or animals aboard, as well as to participate in regattas, commercial fishing, or any activity prohibited by law.
19. The lessee will bear all costs arising from misuse of safety equipment (flares, life jackets, smoke canisters, beacon, etc.).
20. Subcontracting or subletting is not allowed. The lessee agrees to use the vessel only for themselves, family, or friends, not exceeding the maximum capacity specified for the vessel.
21. In the event of violations of maritime or customs regulations, the captain, and subsidiarily the lessee, will be responsible, releasing the lessor from liability. If authorities seize or impound the vessel due to the lessee, captain, or crew, resulting in delayed return, the penalties specified in clause 13 will apply. The lessee will also bear any fines issued to the lessor during the rental period.
22. The lessor will verify the vessel’s full fuel tank at the start of the rental. The lessee must return it with the same level. Failure to do so will result in a charge for the estimated amount, a €40 penalty, and withholding of the deposit until the tank is refilled.
23. Any disputes arising from this contract will be resolved through arbitration by the Arbitration Court of the Balearic Islands, managed by the Official Chamber of Commerce. Both parties agree to abide by the arbitration award.
24. The lessee acknowledges having been informed of health and safety measures related to COVID-19 and assumes responsibility, releasing the lessor from liability.
